1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Bright Home New ("Company," "we," "our," or "us"), governing your use of our website located at brighthomenew.com and any related services we provide. By accessing our website, submitting an inquiry, signing a project contract, or engaging us for any renovation services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
If you do not agree with any provision of these Terms, you must not use our website or engage our services. We reserve the right to update these Terms at any time, and continued use of our services after changes constitutes acceptance of the modified Terms.
2. Description of Services
Bright Home New provides premium home renovation, remodeling, and related construction services across the United States. Our service offerings include but are not limited to:
- Home décor and interior design
- Exterior and garden renovation
- Home security system installation and maintenance
- Fire security and life safety system installation
- Roof installation, replacement, and maintenance
- Solar panel installation and battery storage integration
- Window installation and replacement
- Floor installation, refinishing, and maintenance
- Bathroom renovation and remodeling
- Whole-home renovations and additions
Specific deliverables, scope, materials, and timelines for each engagement will be detailed in a separate project contract signed by both parties. In the event of any conflict between these Terms and a project contract, the project contract shall prevail for that specific engagement.
3. Quotes, Estimates & Pricing
3.1 Free Consultations
We offer a complimentary 60-minute on-site or virtual consultation to assess your project scope. During this consultation, our project manager will discuss your vision, take measurements and photographs, and provide preliminary guidance on feasibility and budget.
3.2 Fixed-Price Quotes
Following the consultation, we will deliver a fixed-price quote within 7 business days. This quote includes:
- Labor costs for all trades involved
- Material specifications with brand and model numbers
- Permit and inspection fees (where applicable)
- Project management and supervision
- Cleanup and disposal of construction debris
- Applicable taxes
3.3 Quote Validity
All quotes are valid for 30 days from the date of issuance. After 30 days, we reserve the right to revise pricing to reflect current material costs, labor rates, and market conditions.
3.4 No Hidden Fees
We are committed to transparent pricing. The price quoted in your project contract is the price you pay — no surprise line items, no "discovery fees," and no escalating overhead charges. The only exceptions are documented change orders initiated by you (see Section 6).
4. Project Contracts & Scope of Work
Each renovation project is governed by a dedicated project contract that specifies:
- Detailed scope of work with measurements and material specifications
- Project timeline with milestone dates and completion date
- Fixed price and payment schedule
- Warranty terms specific to the materials and workmanship involved
- Site access requirements and working hours
- Permit and inspection responsibilities
- Client-furnished items (if any) and delivery deadlines
- Site conditions and existing-structure assumptions
Any work not explicitly listed in the project contract is considered out of scope and will require a separate change order. Verbal agreements or informal communications do not modify the written contract.
5. Payment Terms
5.1 Standard Payment Schedule
Unless otherwise specified in your project contract, payments follow this schedule:
- Deposit (25%): Due upon contract signing to secure your project slot and order materials. Held in escrow until permits are issued.
- Milestone 1 (25%): Due at completion of demolition and rough-in (plumbing, electrical, framing).
- Milestone 2 (25%): Due at completion of drywall, flooring, and major installations.
- Milestone 3 (20%): Due at substantial completion, prior to final walkthrough.
- Final (5%): Due upon completion of punch list items and project handover.
5.2 Payment Methods
We accept ACH bank transfer, wire transfer, certified check, and major credit cards (Visa, Mastercard, American Express) up to $25,000 per transaction. Credit card payments incur a 3% processing fee.
5.3 Late Payments
Payments are due within 7 calendar days of invoice. Late payments incur 1.5% monthly interest (18% APR) and may result in work stoppage until the account is current. Work stoppage does not extend the project completion deadline.
5.4 Financing
For clients utilizing our financing partners, the lender's terms govern the loan agreement. Bright Home New is not a party to the loan agreement and is not responsible for loan approval, interest rates, or lender-specific requirements.
6. Change Orders
We understand that renovations evolve. Any modification to the original scope — including additions, deletions, material substitutions, or design changes — must be documented in a written change order signed by both parties before work begins.
Change orders specify the adjusted scope, price difference (added or credited), and impact on the timeline. Verbal requests for changes will not be acted upon. All change orders are billed at trade-cost pricing with zero administrative markup.
Client-initiated changes that require rework of completed work will be priced at actual cost plus 15% for project management overhead.
7. Project Timeline & Delays
7.1 Estimated Timeline
Project timelines stated in your contract are good-faith estimates based on typical conditions. While we strive to complete every project within 3% of the original timeline, we cannot guarantee exact completion dates due to factors outside our control.
7.2 Force Majeure
We are not liable for delays caused by:
- Acts of God (severe weather, earthquakes, floods, wildfires)
- Government actions (permit holds, inspection backlogs, lockdowns)
- Utility company delays (power, water, gas shutoffs)
- Material supply chain disruptions beyond our control
- Labor disputes affecting our subcontractors
- Discovery of hazardous materials (asbestos, lead, mold) requiring remediation
- Hidden structural damage not visible during initial assessment
7.3 Client-Caused Delays
Delays caused by the client — including late material selections, missed decision deadlines, denied site access, or change requests mid-construction — will extend the project timeline accordingly. Storage fees may apply for materials held longer than 30 days pending client decisions.
8. Workmanship Warranty
Bright Home New stands behind our work with the following warranty coverage:
- Essential-tier projects: 5-year workmanship warranty
- Signature-tier projects: 10-year workmanship warranty
- Estate-tier projects: 15-year workmanship warranty (up to 25 years on structural elements with optional extension)
8.1 What's Covered
Our warranty covers defects in workmanship performed by our crews and subcontractors, including: structural failures attributable to installation, plumbing leaks at connection points, electrical faults at our installed junctions, tile and flooring adhesion failures, and paint adhesion failures.
8.2 What's Not Covered
- Normal wear and tear from regular use
- Damage from client misuse, abuse, or neglect
- Damage from natural disasters or weather events
- Issues caused by third-party modifications or repairs
- Manufacturer defects in materials (covered by separate manufacturer warranties, which we will assist in claiming)
- Aesthetic changes due to client preference
- Damage from lack of recommended maintenance
8.3 Warranty Claims
To file a warranty claim, contact us at warranty@brighthomenew.com with your project contract number, photos of the issue, and a brief description. We will respond within 5 business days and schedule a site visit within 15 business days. Approved warranty work is performed at no cost to you, including labor and materials.
8.4 Warranty Transfer
Our workmanship warranty is transferable to new homeowners for a one-time $250 transfer fee. The transfer must be requested within 60 days of property sale closing.
9. Client Responsibilities
To ensure your project proceeds smoothly, clients agree to:
- Provide accurate information about existing conditions, including known defects, hidden damage, and prior renovations.
- Make material selections within agreed-upon deadlines (typically 7–14 days from presentation).
- Provide unobstructed site access during agreed working hours (typically 8am–6pm, Monday–Friday).
- Remove or protect personal belongings in the work zone. We are not liable for damage to items left in the construction area.
- Make timely payments per the contract schedule.
- Communicate any concerns promptly through your dedicated project manager rather than directly to subcontractors.
- Obtain HOA pre-approval where required (we can assist with submissions, but approval is your responsibility).
- Notify us immediately of any changes to project scope, timeline, or budget.
10. Cancellation & Termination
10.1 Cancellation by Client
Cancellation must be submitted in writing. Cancellation fees apply based on project stage:
- Before work begins: Deposit refunded minus 10% administrative fee and any non-refundable material deposits.
- After demolition begins: Deposit forfeited; client pays for completed work and materials to date.
- After 50% completion: Client pays for completed work, materials, plus 15% termination fee on remaining contract value.
10.2 Termination by Company
We may terminate the contract if:
- Client fails to make payments within 14 days of due date.
- Client materially breaches the contract and fails to cure within 10 days of written notice.
- Client becomes abusive, threatening, or creates an unsafe work environment.
- Client requests work that violates building codes, safety standards, or law.
- Project becomes economically unviable due to undisclosed site conditions.
10.3 Force Majeure Termination
Either party may terminate the contract without penalty if force majeure conditions (Section 7.2) persist for more than 90 consecutive days.
11. Intellectual Property
All design drawings, 3D renderings, architectural plans, and creative work product developed by Bright Home New remain our intellectual property until full payment is received. Upon final payment, you receive a non-exclusive license to use the designs for your personal residence only.
You may not reproduce, sell, or distribute our designs without written consent. We retain the right to photograph and showcase completed projects in our marketing materials, unless you have explicitly opted out in writing.
12. Limitation of Liability
To the maximum extent permitted by law, Bright Home New's total liability arising from any project or service shall not exceed the total contract value paid by the client for that specific project. We are not liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of use, loss of income, or loss of business opportunities
- Damage to personal property left in the work zone
- Claims arising from third-party modifications to our work
- Damage caused by pre-existing conditions we could not have reasonably discovered
This limitation applies even if we have been advised of the possibility of such damages. Some jurisdictions do not allow limitation of liability for certain damages, so this section may not apply to you in full.
13. Indemnification
You agree to indemnify, defend, and hold harmless Bright Home New, its officers, employees, subcontractors, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your breach of these Terms or your project contract
- Your inaccurate or incomplete disclosure of property conditions
- Your failure to obtain necessary HOA or municipal approvals
- Injury to persons or damage to property caused by you or your invitees at the project site
- Third-party modifications to our work performed without our consent
14. Dispute Resolution & Arbitration
14.1 Good Faith Negotiation
Both parties agree to attempt to resolve any dispute through good-faith negotiation for at least 30 days before pursuing other remedies. Negotiations shall be conducted between senior representatives of both parties.
14.2 Binding Arbitration
If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Construction Industry Arbitration Rules. Arbitration shall take place in Casa Blanca, New Mexico, and shall be conducted by a single arbitrator with at least 15 years of construction industry experience. Judgment on the award may be entered in any court of competent jurisdiction.
14.3 Class Action Waiver
You agree that any dispute will be resolved individually and not as part of a class action or representative proceeding.
15. Website Use Terms
15.1 Permitted Use
You may use our website for personal, non-commercial purposes including researching services, submitting inquiries, and communicating with us. You agree not to:

15.2 User Content
